Data Protection Statement
Binghams is committed to protecting the privacy, security and accuracy of your personal information. We will ensure that information we hold about you is managed lawfully, securely, and fairly and that you are fully informed of how we will use your personal data. This statement sets how we collect, store and use your data, in accordance with the General Data Protection Regulations (GDPR). It also sets out your rights.
Definition of ‘personal data’
Under GDPR personal data is defined as “any information relating to an identifiable person who can be directly or indirectly identified in particular by reference to an identifier.” This includes data that is processed digitally or manually (paper copy). It may also include information about how you use our website and other services. This applies to employees, clients, and contacts.
We are Binghams, the data controller. We are responsible for managing your personal information.
In this document ‘we’ and ‘our’ refers to Binghams. ‘You’ and ‘your’ refers to the individual whose data is being processed by Binghams. We are required to provide you with information about how we process your personal information. We reserve the right to update this privacy notice at any time, and we will provide you with an updated version when any substantial changes are made. The current Data Protection Notice will be available to view on the website.
It is important that you read and understand this notice, together with any other privacy notice we may provide when we are collecting or processing personal information about you, so that you are aware of how and why we are using such information.
This notice applies to all employees, clients, partners, and contacts.
What personal information do we hold on you?
The information we hold on you will depend on the nature of the relationship between Binghams and yourself. We will collect only as much information as is required to service this relationship. If any of the personal information we request is optional we will inform you of this.
Information requested may include the following:
- Personal information including contact work / home details (name, address, telephone, email etc)
- Demographic information such as postcode, preferences and interests
- Other information relevant to surveys and / or offers
In most circumstances this information will be provided directly by yourself to us. Where information is provided by a third party we will send you a copy of our Data Protection Statement within a month of receiving your information from a third party.
How do we use your personal information?
We will only use your personal data where we have a valid reason for doing so. We will process your personal details:
- to fulfil our contractual obligations to you, or because you have asked us to do something for you before entering into a contract with us;
- because you have given your express consent for us to contact you;
- in cases where we are obliged to do so in order to comply with the law;
- in ways you would reasonably expect when we have judged this to be in your or our legitimate interests.
If we wish to process your information for any other reason we will contact you to explain the legal basis of our intention. Please note, we may process your information without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.
How long will you keep my personal information?
We will only keep your data for as long as we need it. How long we need data depends on what we are using it for. This is often set by the law.
We will actively review the personal data we hold and when there is no longer a need for us to hold it, we will either delete it securely or in some cases anonymise it.
We aim to destroy any paper copies of your personal data as soon as they have served their purpose (e.g., once information has been entered into a system / once paper copies are no longer required).
How do we share your information with others?
There may be occasions when we need to share your information with third parties, including accountants and auditors, and others in the normal course of our business or when required to do so by law. This is not an exhaustive list. We may also share your personal data in the event of an emergency in order to protect you or another person. Your data may be shared with a third party outside the EU.
We require third parties to process your data in accordance with the law. You should expect the same level of protection from a third party organisation as you do from Binghams.
How do ensure my personal information is securely stored?
We have systems in place to ensure that your personal information is stored securely and is only accessed by those who are authorised and trained to do so. Where personal information is shared electronically files will be protected in transit. Digital information is password protected. Paper copies, where required, are kept securely, access is limited and records are destroyed securely when no longer required.
What rights do I have about how my personal information is used?
If you have given your consent for us to process your personal information you are entitled to change your mind at any time by contacting us. If we are using your personal information on the basis that it is in our legitimate interests you have the right to ask us to stop. You can expect us to respond promptly to any legal request for us to securely delete your personal information.
You also have the following rights. (Please note, there are a small number of occasions where some of these do not apply)
- The right to be informed about the processing of your personal data;
- The right to have your data corrected if it is inaccurate and to have incompleted data completed;
- The right to object to the processing of your personal data;
- The right to restrict the processing of your personal data;
- The right to have your personal data erased, also referred to as ‘the right to be forgotten’;
- The right to request access to what personal data we hold on you and information about how it is processed;
- The right to ‘data portability’ – to be provided with a copy of the data you have provided to us in order for you to transfer that to a third party, or to ask us to transfer it to a third party on your behalf;
- Rights in relation to automated decision making, including profiling.
Exercising your rights does not usually incur a fee. We reserve the right to charge a fee in
exceptional circumstances in accordance with the law.
Please be aware that limiting or restricting the ways in which we process your data may have
implications for the service we can provide to you.
